Welcome to NXT Tutoring! These comprehensive Terms of Service (“Terms”) govern your access to and use of the tutoring services provided by NXT Tutoring Pty Ltd (“NXT Tutoring”, “we”, “us”, or “our”).
By accessing or using our tutoring services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.
1. Payment and Fees
1.1. Payment Authorised: Payment for tutoring services is required after each tutoring session and will be processed via Stripe, our secure payment processor. You agree to provide accurate billing and payment information and authorise us to charge your payment method for the total amount due after each session.
1.2. Late Payments: Payments will be considered late if not received within 5 days of the session date. A warning email will be sent on the 3rd day after a tutoring session of non-payment. If after the 5th day of non-payment, then the late payment will result in a 10% penalty on the total outstanding amount, which will be added to the original fee.
1.3. Suspension of Services: If late payment, including the penalty, is not received after 5 days of the session date, all tutoring services will be suspended until the outstanding amount is paid in full.
1.4. Refunds: Refunds for tutoring services are subject to our Refund Policy, as outlined on our website.
2. Intellectual Property
2.1. Ownership: All materials provided as part of our tutoring services, including but not limited to tutoring materials, curriculum, and website content, are the intellectual property of NXT Tutoring and are protected by copyright laws.
2.2. Restrictions: You agree not to reproduce, distribute, modify, or create derivative works of any such materials without our prior written consent.
2.3. Usage Rights: By participating in our tutoring sessions, you grant NXT Tutoring the right to use any feedback or suggestions provided by you for the improvement of our services.
3. Limitation of Liability
3.1. Disclaimer: To the maximum extent permitted by law, NXT Tutoring shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our tutoring services.
3.2. Indemnification: You agree to indemnify and hold harmless NXT Tutoring, its directors, and contractors from and against any claims, liabilities, damages, losses, and expenses, including but not limited to legal fees, arising out of or in connection with your use of our services.
4. Privacy Policy
4.1. Privacy Practices: Your use of our tutoring services is also governed by our Privacy Policy, which explains how we collect, use, and disclose personal information. By using our services, you consent to the terms of our Privacy Policy.
4.2. Data Security: NXT Tutoring implements industry-standard security measures to protect your personal information, but we cannot guarantee absolute security.

5.1. Modification: We reserve the right to modify or replace these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. It is your responsibility to review these Terms periodically for changes.

6.1. Jurisdiction: These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
